As an experienced New Jersey Divorce Lawyer, I often advise my clients about the waiting times before filing for divorce based on grounds.

    • Extreme Cruelty – You must wait three months to file, but you can look back three months to date when the cruelty started
    • If you are filing for extreme cruelty, you will need to provide at least 5-10 examples of an occurrence.
    • Separation requires you to be separated for a minimum of 18 months. This is means you must be completely separated with nothing to do with each other.
